MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Friday 26th February 2010 from 10:13 am to 11:43 am.

Present: Councillor Lesley Ingham (Chairman), Councillors Bobbin and Paul Sturdgess.

Officers Present: Joanne Hammond, Michael Hawkins and Clare Thornby.

Also In Attendance: PC Barbara Murray (Kent Police), Mr Michael Moss (Licensing Enforcement Officer, Swale Borough Council), Mr P Kee (Counsel representing the Premises Licence Holder) and Mr A Mohammed (Premises Licence Holder).

The Chairman opened the meeting by introducing the Sub-Committee and the Officers present. She then outlined the procedure that would be followed.

review of premises licence under the licensing act 2003 - cherry express (convenience store), sheerness

PC Murray reported that Kent Police had requested a review of the Premises Licence at the Cherry Express convenience store in Sheerness under the Prevention of Crime and Disorder Licensing Objective, following the seizure of a quantity of non UK duty paid alcohol, cigarettes and tobacco from the premises and flat above.

PC Murray referred Members to the witness statements provided by Mr Phillips (Trading Standards Officer), PC Rowley (Kent Police Licensing Officer) and Mr Owers (Higher Officer of HM Revenue and Customs). PC Murray explained the background to the request for a review of the premises licence.

The meeting was adjourned from 10.28 am to 10.36 am to allow Members of the Sub-Committee time to read the tabled statement from Mr Owers.

Mr Moss (Licensing Enforcement Officer, Swale Borough Council) referred the Sub-Committee to his witness statement and provided information to the Sub-Committee on his visits to the premises.

Mr Kee (Counsel representing the Premises Licence Holder) questioned PC Murray and Mr Moss at length.

The Licensing Sub-Committee adjourned at 11.31 am and reconvened at 11.42 am.

RESOLVED:

(1) That the Review of the Premises Licence under the Licensing Act 2003 - Cherry Express (convenience store), Sheerness be adjourned to allow Mr Phillips (Trading Standards Officer), PC Rowley (Kent Police Licensing Officer) and Mr Owers (Higher Officer of HM Revenue and Customs) to attend a re-convened meeting of the Licensing Sub-Committee.
